For anyone buying a lot in Port McNeill, on subjects, or planning a suite, shop or shed: the short version of the rules that decide what you can build. Everything here comes from Port McNeill’s Zoning Bylaw No. 705, 2021 (adopted September 8, 2022) and its Planning Procedures Bylaw No. 718, 2023, read in September 2026. 2 · Zoning basics

The main residential zones in Port McNeill

Port McNeill’s zoning bylaw is Zoning Bylaw No. 705, 2021, adopted September 8, 2022. Every lot sits in one zone, and the zone decides what can go on it:

  • R-1 Residential One — a house with a secondary suite, or a duplex. A new house lot needs 659.3 m². Setbacks 7.6 m front and rear, 1.5 m sides; 8 m high; 35% lot coverage (s.8.1).
  • R-2 Residential Two — a house or manufactured home with a suite, or a duplex, on lots from 464.5 m² (s.8.2).
  • R-3 Residential Three — one house or manufactured home, 5.3 m high; no suite in the 2022 text (s.8.3).
  • R-4 Residential Four — houses, duplexes and townhouses, with suites (s.8.4).
  • CD-1 Comprehensive Development One — a house with a suite, plus a detached cottage up to 70 m² on lots of 2,000 m² or more (s.8.9).
  • A-1 Rural Residential — one house or manufactured home on 2.4 ha or more, plus farming; no suite listed (s.7.1).
  • RM-1 covers apartments and townhouses, and RMH-1 the manufactured home park.

Provincial law (Local Government Act s.481.3) now requires single-family zones to allow a suite or accessory dwelling. On an R-3, A-1 or RMH-1 lot, ask the Town whether an amendment since 2022 has added one.

3 · Everyday projects

Fences, decks, sheds, suites, RVs and home business

  • Sheds and accessory buildings — not in front of the house, 3 m from it, 1 m from side and rear lines, up to 4 m high and no bigger than 8% of the lot or 55 m². A shed of 13 m² or less and 3 m or less high can sit right on a side or rear line, except a corner lot’s street side (s.5.10).
  • Decks and porches — can reach 1.5 m into front and rear setbacks and 0.8 m into side setbacks (s.5.11). When a deck needs a building permit: ask the Town.
  • Fences — nothing over 1.0 m in a street-corner sight triangle (s.5.6). Other fence heights aren’t in the zoning bylaw; check with the Town.
  • Secondary suites — one per lot where the zone allows it, up to 90 m², under 40% of the house’s living space, two bedrooms at most (s.5.13). House plus suite needs 3 parking spaces (s.5.14).
  • RVs — you can live in one only while you build — after the permit issues, for up to 12 months or until the house is occupied (s.5.7), with a $1,000 security. No more than two unlicensed vehicles, RVs or boats on a lot (s.5.12).
  • Home business — residents plus one outside employee, indoors, up to 30% of the floor area or 83 m², no outdoor storage (s.5.3). B&Bs are allowed in R-1 to R-4 and CD-1 (s.5.9).
  • Shipping containers — not allowed on residential lots except as storage during an active building permit, removed within 14 days (s.5.8).

  • Which zone is the lot actually in? Check the zoning map, not the listing.
  • Is it in a permit area, floodplain or stream setback? Each adds steps and cost.
  • Is it on the Town’s water and sewer? That decides what you can add.
  • What’s on title? Covenants and rights-of-way can limit a lot more than zoning does.
  • Anything you’ll spend money on: confirm it with the Town of Port McNeill planning office.

6 · Local specifics

What’s different about Port McNeill

  • The flood line. No habitable floor lower than 1.52 m above the natural boundary of the sea or a watercourse, and none within 15.24 m of a watercourse’s natural boundary (s.5.6.1). On a waterfront or creekside lot, that decides where the house goes.
  • Streams. The provincial Riparian Areas Protection Regulation doesn’t apply in the Mount Waddington region, so the Town’s own setbacks above are the ones that bite.
  • Permit areas and hazards. Development permit areas, wildfire and farmland (ALR) status weren’t confirmed for this page. Ask the planning office, or get a free check, which flags them for your lot.
